These Terms of Service (“Terms”) govern your access to and use of the BenefitReconmobile application and related websites (collectively, the “Service”) provided by BenefitRecon(“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

BenefitRecon helps members of the military community discover nearby discounts, free services, and other benefits. The Service provides informational listings, including benefit summaries, eligibility notes, terms, sources, and verification status. You can browse without an account; some features, such as saving benefits, require one.

No Affiliation; Informational Only

BenefitRecon is an independent service and is not affiliated with, endorsed by, or sponsored by the U.S. Department of Defense, any branch of the armed forces, or any government agency. Listings are provided for informational purposes only and do not constitute an offer by us. Benefits are offered, and may be changed or withdrawn, solely by the businesses and organizations that provide them.

Eligibility and Benefit Verification

Eligibility for any benefit varies by offer and is determined by the provider. A listing does not guarantee that a benefit is available to you. Before relying on a benefit, you are responsible for confirming current terms, eligibility, required proof, and availability directly with the provider. We strive for accuracy and label verification status and last-verified dates, but we do not guarantee that any listing is complete, current, or error-free.

Accounts

  • You must provide accurate information and keep your credentials secure.
  • You are responsible for activity that occurs under your account.
  • You must be at least 13 years old, or the age of digital consent in your jurisdiction.
  • We may suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Submit false, misleading, or abusive reports or content.
  • Scrape, harvest, copy, or republish listings or data except as expressly permitted by us.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service.
  • Reverse engineer or misuse the Service except as permitted by law.

User Submissions

If you submit reports, feedback, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content to operate and improve the Service. You represent that you have the rights to submit such content and that it is accurate to the best of your knowledge. Submitted reports enter a review queue and do not directly modify public data.

Intellectual Property

The Service, including its software, design, and original content, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

Third-Party Services and Links

The Service may link to third-party websites, sources, and applications, including map and directions providers. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, CURRENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BENEFITRECON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Indemnification

You agree to indemnify and hold harmless BenefitRecon and its affiliates from any claims, damages, liabilities, and expenses arising from your misuse of the Service or violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.

Changes to These Terms

We may update these Terms from time to time. We will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the United States and the state in which we are established, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
